As the battle to curb the escalation of defilement cases rages on, the Mzuzu Chief Resident Magistrate Court has convicted and sentenced a 24 year old man identified as Austin Banda to 15 years imprisonment with hard labour for defiling a 11 year old girl.
The court, through prosecutor Felix Senzani, heard that the convict and the girl’s parents were neighbours. On May 27, 2017, he was caught red handed defiling the girl in a nearby maize field.
“The matter was reported to Luwinga Police Unit and medical report indicated defilement took place. Thereafter Banda was arrested”, said Cecilia Mfune, Mzuzu police deputy spokesperson.
Appearing in court, he admitted the charge but pleaded for a lenient punishment saying he is an orphan.
Nevertheless, the prosecutor said Banda deserved a stiffer punishment not only because the girl is under age but also that Banda was a neighbour to her hence was supposed to protect her.
When passing judgment Chief Resident Magistrate Gladys Gondwe said the victims of defilement cases remain traumatized for life hence need for meaningful sentences. She therefore sentenced Banda to 15 years to suit his character.
Banda hails from Kamba Village in the area of Traditional Authority Nsabwe in Thyolo.
