The magistrate court sitting in Nkhata Bay has convicted and sentenced a 25 year old Bright Banda to 9 years imprisonment with hard labour after he was found guilty for the offence of breaking into a building and committing a felony therein.
The court through police prosecutor Sgt. Keston Chiona heard that on the night of April 15 2017, Banda and eight other unknown criminals who are still at large broke into Nkhata Bay National Bank Services (NBS) where they stole CCTV unit, three desk top computers and Digital Subscriber Line Gadget and later tampered with ATM back door.
“Bright Banda was arrested on the same night and when he appeared before Nkhata Bay First Grade Magistrate court on April 28, 2017 he pleaded guilty to the charge of breaking into a building and committing a felony contrary to section 311 of the country’s penal code”, said Ignatius Esau, Nkhata Bay Police relations officer.
In mitigation, Banda pleaded for leniency when sentencing him saying he was deceived by his friends and also that he can positively assist in the development of this country if given chance since he has learnt some lessons during the period he has been in prison.
Passing sentence, First Grade Magistrate, Maston Phiri concured with the state on its submission that cases of this nature are on the rise in the district and as a measure to put a stop to it, the convict deserved a stiffer punishment.
The magistrate later handed Bright Banda who comes from Chileka village in the area of Traditional Authority (TA) Kalolo in Lilongwe district a 9 year jail term with effect from the date of his arrest.
