Chief resident magistrate court in Mzuzu on Thursday, August 4 2016, slapped a 29 year old man to 16 years Iprisonment with Hard Labour for defiling a 9- year old girl.
The court heard that on June 15, 2016 at Lupaso location in the city of Mzuzu the convict, Joseph Gomani Banda had unlawful carnal knowledge with a girl under 16 years contrary to section 138 of the Penal Code.
The State Prosecutor, Assistant Superintendent Betty Msowoya told the court that the convict gave the victim MK100 soon after defilement to conceal the deal.
It was on record in court that the 9-year old standard 3 pupil on the material day at around 2000hrs was heading home when she met the convict on the way who dragged her to a nearby unfinished house and defiled her.
At this time parents of the victim were busy searching for her. When she got home she narrated what has transpired to her parents who later on reported the matter to Luwinga Police.
The convict pleaded not guilty to the charge which prompted the state to parade five witnesses that included a medical practitioner who wrote a medical report confirming that defilement took place.
Although the convict mitigated that he was a bread winner of his family, chief resident magistrate Texious Masoamphambe concurred with the state’s submissions that such defilers are dangerous to girls in our country.
He therefore proceeded to sentence the convict to 16 year jail term which is aimed at isolating such evil minded men from innocent young girls.
Meanwhile law enforcers in the city commended the court for melting out a meaningful sentence which has a potential of deterring would be offenders thereby protecting our girls.
Furthemore parents are called upon to appropriately advise their children to be home on time to avoid vulnerably falling victims of such incidents.
