As the battle to combat defilement cases rages on, the magistrate court in Nkhata Bay has slapped a 25 year old man Jacob Sichali with a 13 year jail term after finding him guilty for defiling a 14 year girl in the district.
Police prosecutor Sergeant Keston Chiona told the court that Sichali and the victim’s parents were living as neighbours and on the night of March 18, 2017, the convict invited the victim into his house where he deceived her to collect items sent by her father. Instead of colleting the so called items, Sichali defiled her.
“The issue came to light after the victim revealed it to her parents who later reported the matter to police. Two days after the incident, the suspect was arrested and was charged with defilement contrary to section 138 of the penal code and when he appeared before Nkhata Bay First Grade Magistrate court, he pleaded not guilty and the state in its quest to find the guilt of the accused, paraded three witnesses”, Esau told News Watch Reviews.
“On April 12, 2017, the suspect was found guilty and in his mitigations, he asked for leniency saying he looks after his family, his sister who is HIV positive and his elderly father and if sent to prison, the aforementioned beneficiaries will suffer most”, said Nkhata Bay Poice publist Ignatius Esau.
Passing sentence, FGM Anthony Banda noted that cases of defilement are on the rise not only in Nkhata Bay but Malawi as a whole and as measure to deter other people from committing the same offence, people convicted on this offence deserve to be punished severely.
Jacob Sichali who comes from Mwene Ipenza village under Traditional Authority Kameme in Chitipa district was later sentenced to 13 years imprisonment with hard labour.
